Ousmane-Diallo-arrêté-par-léquipe-dInterpol-et-du-GALFLes efforts inestimables consentis par le BCN d’Interpol, le ministère de l’Environnement et le projet Guinée-application de la loi faunique (Galf) sont mis à rude épreuve avec la libération de Ousmane Diallo. Une décision de Sékouba Condé, substitut du procureur général près la Cour d’appel de Conakry. Sans l’aval de sa hiérarchie et en violation flagrante de la procédure en la matière, le magistrat a ordonné la libération de Ousmane Diallo un trafiquant faunique de réputation internationale.

Pour sa part, Galf dénonce énergiquement les agissements de Sékouba Condé, substitut du procureur général près la cour d’appel de Conakry, qui a ordonné discrètement, de manière irrégulière et singulière la libération de  Ousmane Diallo alors qu’il purgeait sa peine. Un tel comportement inconvenant de la part d’un magistrat de la République est totalement inacceptable.

Beaucoup d’efforts pour démanteler le réseau de trafiquants fauniques

En janvier 2013, après plus de dix mois d’investigations intenses sur un réseau de trafic international de primates, Interpol a procédé à l’arrestation de deux de ses complices avec l’appui du Galf.  Ousmane Diallo, le commanditaire de ce réseau s’était enfui. Ils étaient tous poursuivis pour flagrant délit de détention d’espèces animales intégralement protégées, importation d’animaux vivant sans certificat d’exportation du pays d’origine en violation des dispositions de la loi L/97/038/AN portant code de protection de la faune sauvage et réglementation de la chasse.

Ousmane Diallo avait admis avoir vendu plus de 500 chimpanzés depuis 1994 ainsi que des lions vivants, hyènes, panthères et des milliers d’oiseaux, ce qui fait probablement de lui le plus important trafiquant de grands singes jamais poursuivi en Afrique.

Suite à cette arrestation, les deux complices ont été déférés au tribunal de ^première instance de Dixinn où ils ont été jugés et condamnés- le 23 juillet 2013 -  à six mois de prison. Quant à Ousmane Diallo, en fuite, il avait été condamné par défaut à un an d’emprisonnement, 150 000 GNF d’amende et au payement de 50 000 000 GNF (7,200 USD) de dommages et intérêt.

Après six mois de recherche,  il a finalement été arrêté et placé en détention suite au mandat d’arrêt décerné par le même tribunal. Il a fait opposition de la décision et a été rejugé de façon contradictoire. Le 2eprocès ainsi engagé s’est soldé par la condamnation du prévenu - le 5 novembre 2013-  à six mois de prison ferme, 150 000 GNF d’amende et au paiement de 120 000 000 GNF soit 17, 200 US dollars de dommages et intérêt au profit du ministère de l’Environnement qui s’est constitué partie civile. Son avocat a fait appel de cette décision et l’affaire est pendante à la cour d’appel de Conakry depuis le 19 décembre 2013.

De la libération illégale de Ousmane Diallo par  Sékouba Condé

En dépit de la bonne volonté et la détermination de certains magistrats pour l’application correcte de la loi faunique, d’autres travaillent la nuit pour défaire ce que font leurs collègues le jour.

Le 10 janvier 2014, Galf a appris avec stupéfaction la libération du détenu qui semble avoir eu lieu fin novembre. Aucun accès n’était autorisé à la prison centrale après le 19 novembre, rendant les visites de prison difficile. Cette mesure de l’administration pénitentiaire faisait suite à l’éclaboussement d’un cas typique de libération illégale d’un présumé assassin. Et pourtant durant toute la période qui s’est écoulée, l’administration pénitentiaire a toujours confirmé la présence d’Ousmane Diallo.

Afin de faire la lumière sur cette libération et avoir des preuves suffisantes, Galf a demandé le service d’un cabinet d’huissiers pour faire le constat. Le procès-verbal du constat fait état de la libération de Ousmane Diallo, le 21 novembre 2013, suite à un ordre de libération du procureur général signé par ordre d’un de ses substituts généraux en l’occurrence Mr Sékouba Condé.

Pour s’assurer de la régularité de cet acte, Galf a saisi le procureur général près la cour d’appel avec l’appui du point focal de lutte contre la criminalité faunique du ministère de la Justice en l’occurrence Mr Mamadou Dian Bora Diallo, substitut du procureur du tribunal de première instance de Kaloum. Le procureur général a clairement décliné sa responsabilité et dit ne pas être au courant de cette libération.

Il est donc clair que son substitut Sékouba Condé a pris cette décision seul et en violation des règles de procédure en la matière.

Cette libération est illégale puisqu’en la matière, seule la cour sur appel – non un substitut général- a la faculté de donner main levée du mandat de dépôt émis par le tribunal et ce par décision spéciale et motivée.

Toutefois, le ministère de l’Environnement et Galf avec l’appui de ses partenaires sont loin de lâcher prise dans cette affaire. Des démarches sont  entreprises auprès de la cour d’appel afin que ce trafiquant d’envergure internationale réponde de ses actes et subisse la rigueur de la loi. Ainsi, selon l’avocat général en charge du dossier et en vertu de la cédule de citation signifiée au prévenu, la première audience en appel se tiendra ce lundi 10 février 2014, ce qui marquera le 3e jugement à son encontre.

Les garanties seront prises pour veiller sur la procédure afin que le droit soit dit. Il va sans dire que ce nouveau procès sera encore suivi avec attention par la communauté internationale.

La Guinée a été identifiée comme étant la plaque tournante du trafic de grands singes vivants à l’échelle internationale, ainsi que d’autres espèces animales protégées. En mars 2013, elle a été sanctionnée par une suspension du commerce des espèces listées par la CITES  (Convention sur le commerce international des espèces de faune et de flore sauvages menacées d’extinction), suite à une très mauvaise gestion dans la mise en œuvre de cette convention internationale. En effet, de nombreux permis CITES frauduleux ont été délivrés par la Guinée pour exporter des animaux, facilitant ainsi le commerce illégal d’espèces protégées. En mars 2012, Interpol a révélé qu’au moins 130 chimpanzés et 10 gorilles ont été exportés illégalement de la Guinée durant les trois dernières années, principalement vers la Chine.
